View Full Version : Learners Permit + Intoxicated Adult = ?

I've had my learners permit for quite some time now, and I have always been a designated driver for my parents or friends or whatever. One question has been on my mind though. Is it legal to drive with an intoxicated 21+ year old as the adult, or do they have to be sober? I know you legally have to have a 21 y/o adult with a valid license in the front passsenger seat (or 18 y/o spouse...odd I know...), and common sense tells me that it's probably illegal, but I would like to know without a doubt. Does anyone know the penalty if cought if it is illegal?

Technically I dont think it is, but in Drivers Ed, it was mentioned a Cop wouldnt get you in trouble for doing the right thing and having you drive.

It's not exactly the most responsible course of action is it?
But it is a good way of getting driving experience though.... experience of not letting drunk people into your car or face the smell of vomit :D

Well, when it comes to my Dad it's not really a choice. Either I drive my dad home so he's at least semi safe, or he'll drive home drunk. I really don't want him doing that, seeing as how he was just in jail a couple years ago for too many DUI's :tear:.
Edit: I'm not looking at this as a experience kind of thing. I am just worried about what happens when I do something stupid by accident and a cop pulls me over while the only adult is a drunk one in the passenger seat...

It will depend on the state, but generally it is a competent PARENT/GUARDIAN (not just a 21+) who is fully alert at the time.

Hahaha, explain that to a plastered guy.
Oh, and his friends are usually the ones that get the most smashed with him, so thats a no go lol.

It's better if you drive him and risk getting pulled over by a cop (who will probably be understanding) instead of having him drive drunk and risk injury or life.

No... it isn't legal... with a learners permit you need an aware (sober) parent/guardian (over 18) or a sober friend (over 21) to watch you...

Don't know about your state, but here I know for a fact its 21+ adult or 18+ year old spouse.
Anyhow, maybe I'll get lucky and he'll stay here past 11. Then I can force him to stay over (I'm at my moms). He doesn't want to believe that he has to be sober, but if I can give the "Can't drive between 11pm-5am law" in addition to that I should be able to get him to stay.
