I searched it up and the problem in BF3 with 3D spotting was that snipers could spot and snipe the target without having direct LOS with it, right?

Well first I didn't see tall grass or any other similar soft type of obstacles so far in PS2 (but I'm aware that this could come on other continents). Also I read that they fixed that problem so you couldn't spot if you didn't have direct LOS anymore.

Also I suggest that the spot marker is active only as long as the spotter has the target he spotted in sight. So if i.e. Infiltrator spots an enemy MAX and wants to inform his comrades of his position he should maintain that target in his visual field - if the visual contact with target is lost for more than 5 seconds spot marker disappears and has to be reactivated.

If there are some other problem with this spotting technique I'm not aware of please bring it to my attention.
The problems are:
1. It shows you exactly where to place your aiming sight, so it's 4th wall breaking aid from the game. People are shooting at the marker, not the player, and that's especially true at long distance when the silhouette of the player is too small. This means a light assault 300m away, standing next to a tree and you can't see him - well, now you can.
2. It's bad enough in BF when a spot shows you to 32 enemies - and now it's going to show you to 300? (yes, I know making it squad only would fix this part)
3. It's often used in BF3 to Q spam. This means, look out across the battlefield, and hit Q- and boom! A guy you didn't even know was there, now you have a triangle. It's also used by people who chase enemies at close quarters to see where they go if they run behind cover. These are therefore uses for the spotter himself to have an easier kill, not, therefore, teamwork.
4. It supports campers, primarily snipers. Most campers are usually sitting next to good cover, so if you shoot at them, they will simply move behind it. People running out in the open though, they are good targets for snipers who are ready and willing to shoot 3D spots.
5. It promotes deathmatch play. Instead of heading for the nearest objective, people go for 3D spots, even if they are far away. Promotes, therefore, inefficient play. This may not be a problem for disciplined outfits, but that's not the entire population of the game.

And, you've already pointed out what it might do to night time.
