Learners Permit + Intoxicated Adult = ?


I've had my learners permit for quite some time now, and I have always been a designated driver for my parents or friends or whatever. One question has been on my mind though. Is it legal to drive with an intoxicated 21+ year old as the adult, or do they have to be sober? I know you legally have to have a 21 y/o adult with a valid license in the front passsenger seat (or 18 y/o spouse...odd I know...), and common sense tells me that it's probably illegal, but I would like to know without a doubt. Does anyone know the penalty if cought if it is illegal?
