Selling open beta spot

I was on ebay the other day, and I saw something that caught my eye, some dude was selling his open beta spot. Is this legal. If so my spot is open for sale. Not going to be able to participate due to finals.. Let me know

I wasn't going to try to sell it here. I was just asking if it was legal. If there any way that I can give up my spot to someone else then.

its legal ppl do it all the time its just SOE would have to pay Ebay off agien just like EQ and EQ beta ppl did the same

Selling of the account in any way shape or form is HIGHLY illegal

It is not legal, although SOE did pay EBay off so that they would actively remove account auctions (SOE couldn't get EBay to remove auctions so they paid them off)

Its not yours to sell, the account is provided by SOE and remains their "property". Its their data, on their servers, you just use it under licence.

It is also breach of the NDA to allow anyone to access "your" account.

But i'll take it if its going spare, just throw up the software on kazaa or use an FTP server and give me your IP.

It's not 'illegal' in the sense you're breaking a law, but it is bannable. They will ban you if they find out you're not the origional owner of the beta account. Which isn't hard to find out, since you could be, say, connecting from a different computer than the DXDiag says you should be. :-)

.. I wouldn't actually expect they'd do anything more than ban the person. Don't think SoE ever has done anything more than that.

It's a violation of private law, the law created by the agreement between the beta tester and SOE. Breaching the contract could lead to at least (1) disgorging the profits received by the beta tester, (2) other remedies put into the contract. Banning is one consequense of the breach, but there are other, more serious consequenses opened up on breach. Are you willing to litigate with SOE? With their resources?
