A. Copyright violation claims in MDY Indus. LLC v. Blizzard Entm't, Inc. were thrown out by the 9th Circuit on appeal. Breach of contract (ie, ToS) stuck, and the part of DMCA that stuck was remanded. The issue is unresolved. Further, I'd be very careful in wishing for a world where copying licensed disk content into RAM constitutes grounds for copyright claim if the licensing body isn't happy with you.

B. The judgement on tortious interference (which I assume is what you meant) was vacated. "Causing someone to lose revenue" is not illegal in the US yet.

So, if I were SOE, I wouldn't be relying on that particular arrow in the quiver.

Re: An Aim Bot has emerged

SOE needs to get anti-cheat right because of the client side hit detection. My game once played up and sort of disconnected, making my enemies stand still or slide in their current paths for about 20 seconds. I shot enemies and the game still granted me the kills.

Whilst this was a network hiccup, it shows that the client-side hit detection is vulnerable and someone could easily take advantage of this to say, direct the client to send a kill signal to every player in a particular hex.
