Oh god I spilled this hot coffee on my self. Ive been horribly burned. Its your fault for not telling me the fresh coffee is hot so I wouldnt spill it on my self.
Oh god I got fat. I ate your food for 5 years straight and gained 200 pounds. Oh god your gun poduced a bullet that hit me. Oh god your pocket radio made me go deaf after using it to play extremly loud gay butt sex porn sounds for 12 hours a day. Edit: Oh almost forgot. Im Sueing. This case is more disputable then most would think. The McDonald's that served the old lady the coffee, they made their Coffee hotter than normal. The reason being, to keep it warmer throughout the day, for the customers. Problem was, they never expressed this to their customers. They never said they made their coffee hotter than normal, hotter than any other McDonald's. I'm not backing this old lady who sued, but i'm also not backing McDonald's. The old lady ended up getting 2nd degree burns. Have you ever had 2nd degree burns? Damn they hurt :P I will say the rest of your examples are perfect. This person sueing for hearing loss is complete bullshit. It even states in the manual that it can be loud and can cause hearing loss. I just hope he doesn't win. |

Yea, its not as simple as one would think. We looked at this case in our law class. The accident was preventible, in several respects. First off, Make the coffee cooler. Second, If you make it that hot, place a warning, which wasnt done. Third, a better cup design would have helped, as this case is older, and the common design was yet to be designed. BUT, this is an old lady, not that old people dont matter, driving a car, with a cup of coffee in her lap... First off, if she is that old, I dont think she should be driving and opeing a cup of coffee at the same time (i dont anyone should try to juggle with opening a cup of coffee while driving, at a stop sign is better). Then, she had it in her lap (in between legs)... Doesnt that sound stupid? placing a hot cup of coffee between your legs? So what it boils down to is: Mcdonalds could have had a better cup design, and a warning.Plus, the lady shouldnt have been trying to open a hot cup of coffee while she was driving, plus, she had it between her legs, which is rather dumd. Verdict: Give $1 to Old lady for moral vistory, and recomend a better cup design/packaging to McDonalds. On this case however, Its rather stupid. If this person is to sue Apple (who sucks BTW) for hearing loss from the MP3 player, they need to sue all other MP3 player maker companies. So this narrows it down to its not Apples fault, but would be the industry's problem. Now that sueing Apple is out of the way, lets see why people cant sue because of hearing loss. On the MP3 player are volume controlls, using these effectivley can prevent hearing loss, so with the volume controll you can save or kill your hearing. Now, if Apple didnt include a volume controll mechanism, he could sue for not having the choice of sound level. Since there is a vollume controll, you cant complain that here was no alternative. Now, if you worked in a noisy place, thats a different storry, but for this storry, the person is a dumb ass. |

Ok to get it straight, she wasnt driving she was in passenger seat and parked. Her son was driving I believe, secondly she got 3rd degree burns and had to have treatment for 2 years. Thirdly McDonalds was serving coffee at over 170 degrees F and at that temp. 3rd degree burns are cause within 2-7 seconds, she had cotton pants on so when it was spilled her pants soaked it up and continued to burn her for over 90 seconds.

God I hate people who can't take responsibility for their own self-destructive actions. Common sense. Loud music can damage your hearing. Foods full of grease and fat can increase your chances of high blood pressure and heart attack/stroke. Coffee is hot. Don't spill it on you. Sure there are limits. Companies shouldn't make devices that will destroy your hearing in seconds, fast food companies shouldn't make foods obscenely fatty (demonstrated in the most recent episode of "The Boondocks ), and coffee makers shouldn't make it ridiculously hot. The bottom line is, manufacturers need to be responsible for making a product that isn't absurdly dangerous, and consumers need to be responsible for using said product in a safe way.
With stuff like iPods and fast food at least consumers have the choice limit any health-damaging effects, (turn down the volume / go eat a carrot), whereas the coffee-burn arguement holds some truth. I still think if you're going to buy something hot, its your job not to spill it all over yourself. (Says the kid who spills hot coffee over himself all the damn time) |

McDonnalds was at fault in that case because their coffee was dangerously hot, you don't get 3rd degree burns from spilling any old coffee on your lap.
